Lasting Power of Attorney (LPA):
A person losing Mental or Physical Capacity can cause financial hardship for their family due to the fact their assets are frozen. A “Property & Financial Affairs” Lasting Power of Attorney is a document whereby you state who you would like to take over your affairs in this situation. You can also now take out a “Health & Welfare” LPA to name who should be in charge of you and your medical care should you be unable to do so.
Severance of Tenancy:
Most couples own their home as Joint Owners, which can cause problems and possible disinheritance in the event of a surviving owner remarrying or going into Long Term care. A Severance of Tenancy amends the style of ownership so that each person owns half of the property this then can protect at least half the property from these eventualities.
Often used in conjuction with a Severance of Tenancy or a Deed of Gift allowing surviving spouse/partner to live in the property for the rest of their life. However Property Trusts can also give someone else the right to live in your property after your death i.e. an unmarried child or an elderly relative.
These trusts protect the assets you leave to any minor children or grandchildren until they are old enough to inherit.
If you have child who is either Physically or Mentally disabled you may worry that if that child inherits from your estate they will either not be able to cope with a large sum of money, they may be coerced into giving it away and/or the money will be taken to pay for their care. Therefore if their inheritance is placed into a Disabled Trust, it is there to be of benefit for the child but cannot be counted as their assets. Also if your child has a drink, drugs or gambling problem, obviously that child inheriting a large sum of money could do them immense harm. By putting their inheritance into the Trust the Trustees can then decide to release their share of your estate at such a time that your child is free from their addiction. Or if you have a child who is in an unstable marriage, again their share of your estate can be put into a trust until such a time as they are divorced safeguarding any inheritance from becoming part of the divorce settlement.
